GENERAL TERMS AND CONDITIONS SOULSUPYOGA
1.1 General Conditions: these general terms and conditions used by SOULSUPYOGA, which are published on the website of SOULSUPYOGA, www.soulsupyoga.com.
1.2 Participant: the person participating in SOULSUPYOGA organized by SOULSUPYOGA, Workshop, Training or Retreat.
1.3 SOULSUPYOGA is located in Wijk aan Zee at Sint Odulfstraat 2 and is registered in the trade register under number 34285528.
1.4 Retreat: an individual course program organized by SOULSUPYOGA consisting of suppen and yoga of at least 24 consecutive hours.
1.5 Workshop: a course given at SOULSUPYOGA, in which work is carried out on an assignment for a few hours, with suppen and yoga being given meaning to the participant.
1.6 Training: a course given at SOULSUPYOGA, where the participant learns and practices skills in combination with suppen or yoga individually or in groups.
1.7 Suppen: Suppen stands for Stand Up Paddle, and is a form of surf sport where one stands on a surfboard and moves with a paddle. SOULSUPYOGA offers forms of Suppen with an active effort of body and mind aimed at building a good physical and mental condition. Use is made of an accommodation on shore and a course marked with buoys in which the activities take place.
1.8 Yoga: SOULSUPYOGA offers forms of yoga with an active effort of body and mind aimed at a good physical and mental condition with improvement of physical and mental well-being.
1.9 Supyoga: Supyoga is a combination of Suppen and yoga, where one stands on a surfboard, moves with a paddle on a surfboard and practices yoga on the shore and within the set course.
2.1 The General Terms and Conditions apply to all Lessons, Workshops, Trainings and Retreats at SOULSUPYOGA, to the exclusion of other conditions.
2.2 SOULSUPYOGA can change these General Terms and Conditions. The latest version of the Terms and Conditions is always the current version and is available on the Website.
3.Time payment, consequences of late payment and Price change
3.1 The participant pays a Workshop, Training or lesson prior to the start of the lesson, workshop or training. SOULSUPYOGA may refuse participation without payment received.
3.2 The participant pays a Workshop or Retreat no later than 30 days before the planned Retreat. SOULSUPYOGA may refuse participation without timely payment.
3.3 For some Workshops, Training and Retreats there is a so-called "Early enrollment discount". This reduced rate is valid until the date stated on the Website. After this date, the normal rate also applies to the Website.
3.4 The applicable prices for lessons, workshops and training are on the Website. SOULSUPYOGA reserves the right to change the prices of classes, workshops, training courses and other products and services. Any price changes will be announced at least three months in advance in SOULSUPYOGA, and / or by mention on the Website.
4.1 SOULSUPYOGA reserves the right to change the Workshop program due to weather conditions and sea and swell conditions.
4.2 SOULSUPYOGA reserves the right to cancel a planned Workshop due to weather conditions and sea and swell conditions. In that case the already paid registration fee will be refunded to the Participant.
4.3 Up to one (1) month before the planned Workshop date, the Participant can cancel his registration free of charge. This can be e-mailed to firstname.lastname@example.org.
4.4 Up to seven days before the planned Workshop, the Participant can cancel his registration, in which case the registration fee will be refunded with deduction of € 10 administration fee.
4.5 If the Participant cancels his registration within seven days before a planned Workshop, no registration fee will be refunded.
5.1 Cancellation of participation in the planned Retreat can only be made in writing. This can be e-mailed to email@example.com.
5.2 Up to 30 days before the planned Retreat the Participant can cancel his registration free of charge.
5.3 Within 30 days before the planned Retreat date the Participant can cancel his registration, in which case 5% of the Retreat Price will be charged.
5.4 If the Participant cancels his registration within 14 days before the start of the Retreat, 10% of the Retreat Price will be charged.
5.5 If the Participant can not take part in the Retreat for any reason whatsoever, 75% of the already paid Retreat Price will not be refunded.
5.6 SOULSUPYOGA reserves the right to cancel the Retreat due to insufficient participants. In that case, the Retreat Price already paid (partially) by the Participants will be refunded.
5.7 SOULSUPYOGA reserves the right to change the Retreat program due to weather conditions and sea and swell conditions.
6. Personal data
6.1 SOULSUPYOGA collects personal data from the Participants for the execution of the agreement. SOULSUPYOGA handles this collection of personal data carefully and adheres to the provisions of the Personal Data Protection Act.
6.2 SOULSUPYOGA also uses the personal data referred to in article 7.1 in order to inform the Participants of activities of SOULSUPYOGA and any changes to, for example, the program. If the Participant does not wish to receive communication from SOULSUPYOGA, the participant can make this known via e-mail to: firstname.lastname@example.org. The Participant is aware that in this case all services and products of SOULSUPYOGA may not be used.
7.1 SOULSUPYOGA does not accept any liability for physical and / or mental injuries or injuries, loss or damage related to participation in Workshops, Training and / or Retreats with, or provided by, SOULSUPYOGA.
7.2 SOULSUPYOGA works with qualified teachers and always provides high quality Workshops and Retreats. Nevertheless, there is a risk of injury or injury during a lesson or Workshop or Retreat. By participating in a Workshop or Retreat with, or provided by, SOULSUPYOGA, the Participant accepts this risk of injury and / or injury. SOULSUPYOGA recommends the following to reduce the risk of injury or injury:
Consult a doctor before starting a workshop or retreat if you are not sure that you are completely healthy, or if you are pregnant.
If you have an injury, or other physical discomfort, always report this to the relevant teacher / coach before the start of the Workshop of Retreat.
Listen carefully to the instructions of the teacher in question and follow them up.

Carry out the exercises carefully and take into account your physical limitations.
Do not perform exercises that are painful to you.
Ask questions when you do not understand an exercise.
7.3 When Soulsupyoga has failed in the fulfillment of her commitments, then Soulsupyoga is liable for the resulting damage. The answer to the question whether Soulsupyoga has failed in the fulfillment of its obligations is exclusively determined by Dutch Civil Law.
7.4. Soulsupyoga accepts no liability for damage resulting from death, injury, accident, injury, loss or theft caused to the participant (s) during or as a result of the activity.
7.5 The liability for all other damages will never exceed the price per person paid per participant.
7.6 Soulsupyoga will in any case not be liable for damage that has arisen as a result of:
• actions and influences from third parties that are not directly engaged by Soulsupyoga when performing a Retreat / Workshop
• circumstances that can not be reasonably attributed to Soulsupyoga pursuant to the law or the socially applicable standards.
• loss or damage to luggage and securities.
7.7 Soul yoga yoga can in any case not be held liable as participants:
• not follow instructions from Soulsupyoga staff, who are necessary to ensure the smooth running of the retreat / workshop
• withdraw from provided guidance and instruction during activities.
7.8 SOULSUPYOGA can not be held liable if a certain lesson, instructor and / or consumer product is not available for whatever reason as the core of the Lesson, Workshop. Retreat of Training is achieved. .
7.9 It is the participant's responsibility to ensure that they can pass a series of exercises offered in a program that they follow or in a class they attend. Participants accept the risk of injury when performing exercises and are advised to consult their doctor before starting a lesson.
7.10 SOULSUPYOGA accepts no liability for loss or damage to property of Participants, or for injury to Participants in the SOULSUPYOGA premises, or outside of it, except insofar as such loss, damage or injury can not be excluded by law.
8. Applicable law and dispute settlement
8.1 Only Dutch law applies to the General Terms and Conditions.
8.2 Complaints shall be submitted to SOULSUPYOGA in writing or by e-mail without delay and in any event within three days. SOULSUPYOGA will respond to a complaint within ten working days.
8.3 Any disputes relating to the General Terms and Conditions, a Workshop, Training or Retreat, or attending classes or purchasing other products and services from or at SOULSUPYOGA will initially be settled by a recognized mediator in Amsterdam. If it fails to reach a satisfactory solution for both parties with a recognized mediator, the dispute will be settled with the competent court in Amsterdam.
